I looked at the perks in the server store, and noticed how some of the perks were gameplay advantages. This is a violation of the minecraft EULA.

The EULA was something that mojang announced this previous summer. It stated that any perks given with donator ranks must be cosmetic only, like pets, hats, and the colored name tags. They didn't perks that affected gameplay, such as kits in pvp games. It was also stated that ingame coins are fine, but you cannot buy the ingame coins with real life currency.
Servers were supposed to be EULA-friendly by August 1st, 2014. This was clearly not met, as you guys continue to have gameplay advantage perks nearly 6 months past August 1st, 2014.

    Explanation?

Edit: a man named AJthekidCP sent me

I think survival is one of them.
As far as I know that still isn't allowed. It isn't like mojang gave them permission to do it. And even if J&H did ask then Mojang would deny them.

The EULA is still in effect.
We just don't follow it anymore, due to other servers not following it, and them having a lack of punishment.
Lets face it, minecraft sucked with the EULA.

    He doesn't want to.
Hypixel is close to following EULA. The problem is their network boosters. Mineplex I don't really know.

Hey, you know who else doesnt follow the EULA?

    Most servers.

Maybe when Mojang can actually put their money where their mouth is and remove a server, then server owners will straighten out their servers.

But for now, we reverted to before the EULA(Mostly)

If I'm correct, the in game money gives people certain items. As a result, people with more in game money can get better items more often.
That's pay to win in technicality.

However, most games here don't really give donors a major advantage. In SG there are so many iron swords and diamond axes that there is not too much of an advantage from getting one right off the bat.

The OITC leaderboard is not a gameplay feature, therefore double XP is not pay2win.

Minefighter has the stone pick, but let's be honest. It takes 2o extra seconds to make a stone pick and it's only available with the Hero rank so it's not such a wide spread perk.

Factions is one of the only things we have that is a pay2win type of thing, but most non-donors find their way around it and end up doing well. It it only gets OP at Herobrine/God rank.

Since it is only one thing, I guess it matches up with Hypixel. :O

The server needs money to stay alive, so would you rather have the risk of losing it or having the mediocre disadvantage?

The EULA was not targeted at our either. It was targeted at other servers that charged extreme amounts of money for perks, and kids bought into it, which made parents complain.

The biggest pay2win servers are still out there violating the EULA too. So why worry about this server? Hive used to have that thing when donators kicked others out of games. That was unfair. There's a difference between having a slight disadvantage and not being able to play.

Therefore, I'm pretty sure that the EULA violation is not a big deal, and as perc said, let Mojang walk the walk.

Hypixel credits are used for cosmetic items in the "Vanity Shops."
You can get awesome things like Gadgets that can be used in lobbies.
You can get pets, the ability name your pets, and the ability to wear your pet and more!
